4. The legal basis for processing

As part of the recruitment process, Les Deux collects and processes the following personal information, provided it is permitted under the applicable data protection laws for Les Deux:

  • Sensitive personal information, such as health-related information, is not processed as a general practice. However, it cannot be ruled out that it may become necessary in special situations.

6. The sources from which we collect personal information

Most personal information is collected by Les Deux directly from you, as well as through observations and deductions Les Deux makes about you as a result of the recruitment process. The information we request you to provide may be essential, and in the absence of such information, we may not be able to offer you employment with us. We will notify you in advance, if this applies.

7. Processing of criminal record

Employment may be conditional upon your ability to provide a 'clean' criminal record check at the commencement of your employment and at any subsequent time as reasonably requested by Les Deux.

Les Deux obtains your explicit consent for the processing of your criminal record.

Les Deux may retain a copy of your criminal record for documentation purposes or choose to note whether a clean criminal record has been presented.

Les Deux does not disclose your criminal record unless required by law.

Your personal data may be transferred to suppliers, partners, contractual parties, or other third parties who process data on behalf of Les Deux. When using such data processors, Les Deux ensures that a written agreement is in place, stipulating that the data processor may only process personal data in accordance with Les Deux's instructions and for the purposes specified in this privacy policy. It will be a requirement for the data processor to establish adequate organizational and security measures.

Les Deux may disclose your personal data to public authorities to the extent required by legal obligations.

Les Deux only transfers personal data to countries outside the EU/EEA when appropriate safeguards have been taken to protect them, as required by data protection laws. Transfer of personal data to recipients in third countries will occur with the relevant transfer basis; in most cases, according to the European Commission's standard contractual clauses.

9. Storage period

Personal data is deleted when there is no longer a legitimate purpose for its continued storage. This is done in accordance with Les Deux's data protection policy.

If you have submitted an application to us, we typically retain it for 6 months after a rejection has been communicated, after which it is deleted unless you have consented to longer retention.

10. Your rights

You have the right to request Les Deux to access your personal information. If your personal data is inaccurate or misleading, you have the right to request Les Deux to correct the information. Under certain circumstances, you also have the right to request Les Deux to delete or restrict your personal data or object to processing, as well as the right to data portability.
